Blake Lively Takes Surprising Step in Legal Dispute with Justin Baldoni, Withdraws Emotional Distress Allegation

Blake, the actor Justin Baldoni is being sued by Lively for intentionally causing emotional distress and negligently causing emotional distress. She is attempting to withdraw these charges. In the latest development of her continuing legal battle with her It Ends with Us director-costar over their backstage spat, Blake, 37, asked to withdraw and dismiss her charges on June 2, according to Variety.
The circumstances of Blake Lively and Justin Baldoni's case were flipped
Justin's legal team made the request after attempting to obtain discovery, including her medical records, as part of their defense against her allegation against the director of It Ends With Us. According to Blake, she experienced "severe emotional distress and pain, humiliation, embarrassment, belittlement, frustration, and mental anguish."

Justin's lawyers are now trying to get the actor to sign a HIPAA release in order to gain access to therapy records and other pertinent data
The filing states that Ms. Lively is abandoning her [infliction of emotional distress] Claims, as her counsel recently informed us in writing, rather than following the Medical RFPs.
According to the document, Blake sought to retract claims of emotional distress without bias rather than "complying." This implies that Blake is not only "refusing to disclose the information and documents needed to disprove that she suffered any emotional distress," but also "maintaining the right to re-file her (infliction of emotional distress claims) at an unknown time in this or some other court after the discovery window has closed… Ms. Lively cannot have it both ways."
What did Blake's attorney say?
The lawsuit was described by Blake's attorneys, Esra Hudson and Mike Gottlieb, as a "press stunt" and said that they were only "streamlining and focusing" her case. The court will now have to determine whether to force Blake to disclose the details of her mental health, which she has been trying to hide, or whether to dismiss the two allegations with or without prejudice.
In December of last year, the dispute started when Blake accused Justin of sexual harassment, citing wrongdoing on the set of the Colleen Hoover adaptation and a retaliatory smear campaign, which Justin has disputed. Justin filed a countersuit against Blake, her husband Ryan Reynolds, and their publicists in January, alleging extortion, defamation, and other offenses. The trial for both of the Lively v. Wayfarer Studios et al. cases is set for March 2026.
